When a vehicle is purchased with the assistance of a loan from any financial organisation or bank, the term hypothecation is employed. The lender retains a legal claim over the vehicle until the loan is fully repaid. This is known as hypothecation (HP), and it is reflected in the vehicle's registration certificate (RC).

Removing HP from your RC is an important step when you have fully repaid the loan. It certifies your full ownership of the vehicle and allows you to easily transfer or sell it without the need for further papers.

What is the Hypothecation Removal Process?

Hypothecation termination meaning: Hypothecation removal is the process of removing the hypothecation from your vehicle's RC book or transferring vehicle ownership from the creditor/bank to your name. 

In other words, automobile hypothecation removal or RTO HP (hypothecation) cancellation refers to transferring vehicle ownership from the finance company to the owner.

How to Terminate Vehicle Hypothecation Offline?

Once the loan is repaid in full, it's important to terminate the hypothecation. This removes the lender's claim on the vehicle, giving you full ownership and the freedom to sell or transfer the vehicle without restrictions.

The hypothecation termination process varies depending on your location and the lender. Here's a general overview of the hypothecation removal process through the RTO office :

  • Step 1: Collect the necessary documents, such as Form 35, No Objection Certificate (NOC), Vehicle RC, etc., and submit them to the nearest RTO.
  • Step 2: Submit the application form for hypothecation removal along with the necessary documents and RTO hypothecation removal charges.
  • Step 3: The RTO will verify the documents and process the application. This could take a few days or weeks and ensures the authenticity of the information provided.
  • Step 4: Once approved, you will receive a new registration certificate with the hypothecation removed.

RTO Hypothecation Removal Process Online

The hypothecation cancellation process can also be done online through the steps mentioned below:

  • Visit the official Parivahan Sewa website
  • Click on "Online Services" and then select "Vehicle Related Services."
  • Select your state and RTO office from the drop-down menu.
  • Enter your vehicle registration number and the last five digits of the chassis number.
  • Click on "Proceed" and choose "Basic Services."
  • Enter your registration number and chassis number again, and click on "Validate Registration Number."
  • Click on "Generate OTP" and enter the OTP received on your registered mobile number.
  • Select "Hypothecation Termination" from the list of services.
  • Fill out the application form, including details of the loan financier and NOC.
  • Upload scanned copies of the required documents.
  • Pay the applicable fees online.
  • Make an appointment for document verification at your chosen RTO office.
  • Visit the RTO office with the original documents and submit them for verification. 
  • Once verified, the RTO will update the vehicle RC and remove the hypothecation entry.
  • You will receive the updated RC with the hypothecation removed within a few days through registered post, or you can choose to collect it from the RTO office.

Documents Required for Termination of Hypothecation

The documents required for the hypothecation termination process are listed below:

  • Form 35 and two copies of the same form signed by the bank and the owner.
  • Attested copy of Insurance certificate.
  • Pollution Under Control Certificate (PUCC).
  • Attested copies of PAN Card.
  • Original Registration Certificate or RC.
  • No Dues Certificate.
