RTO Form 21 - Sale Certificate

RTO Form 21, also known as the Sale Certificate, is a mandatory document required for the transfer of vehicle ownership in India. It acts as proof that the seller has legally transferred the vehicle to the buyer and received the sale consideration.

Any individual selling a registered motor vehicle in India must obtain and submit RTO Form 21 along with the transfer application. This applies to all types of vehicles, including cars, motorcycles, scooters, trucks, and buses.

Importance of RTO Form 21

Form 21 sale certificate is an essential document that simplifies and legalises the process of transferring vehicle ownership and registering it with the RTO. Here are some of the important functions of RTO Form 21:

  • Transferring Ownership: Form 21 serves as official proof that ownership has been transferred from you (the seller) to the new buyer. It details the sale transaction, including the date, consideration amount (if any), and signatures of both parties. This provides legal protection for both the seller and buyer.
  • Vehicle Registration: Without a valid Form 21, the RTO couldn't register the vehicle in the new owner's name. It is evidence to verify the vehicle's ownership and complete the registration process.
  • Prevents Misuse and Fraud: The sale certificate helps prevent misuse and fraudulent activities. It provides a clear record of vehicle ownership, making it difficult for someone to claim ownership of a vehicle falsely.
  • Tax Liability Transfer: It facilitates the transfer of tax liabilities associated with the vehicle from the seller to the buyer. The RTO uses this information to assess and collect road tax and other relevant fees from the new owner.
